They do not govern any subscription services, software, pilots, or professional services that Cognisity may provide to customers. Any such services are governed by a separate written agreement (e.g., an order form, master services agreement, data processing addendum, or similar) (a "Customer Agreement"). If there is any conflict between these Terms and a Customer Agreement, the Customer Agreement controls for the services it covers.
You represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization.

You may not copy, reproduce, distribute, publicly display, or create derivative works from the Content without Cognisity’s prior written permission.
If you provide suggestions, ideas, or feedback about the Site ("Feedback"), you grant Cognisity a perpetual, irrevocable, worldwide, royalty-free right to use and incorporate the Feedback without compensation or attribution.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COGNISITY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF COGNISITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COGNISITY’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
You agree to defend, indemnify, and hold harmless Cognisity and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your violation of these Terms or misuse of the Site.
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
We may revise these Terms from time to time. The “Effective Date” above indicates when these Terms were last updated. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
